ASK-AYURVEDA.COM TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of Ask-Ayurveda.com ("Platform"), operated by SWISS AYURVEDA PRIVATE LIMITED ("Company"), registered in India under CIN U86901MP2024PTC073695, with its registered office at H. No. 186, Bhel, Bhopal, Huzur, Madhya Pradesh, India, 462022.

By accessing or using the Platform, you agree to these Terms. If you do not agree, please discontinue use immediately.

1. NATURE OF THE SERVICE

• The Platform is an IT-based solution that facilitates interactions between Users and independent Ayurvedic practitioners ("Practitioners").
• The Company does not provide medical services, diagnoses, or treatments and is not a healthcare provider, clinic, or hospital.
• The Company acts as an intermediary between Users and Practitioners, facilitating communication and advisory, guidance and educational support, but does not guarantee the outcome of any advice or recommendations provided by Practitioners.

2. USER ELIGIBILITY

• Users must be 18 years or older to register for and use the Platform’s services, including paid advisory, guidance and educational support.
• Users must provide accurate, truthful, and complete personal information during registration and while using the Platform.
• The Company reserves the right to suspend or terminate accounts that provide false, misleading, or incomplete information.
• Users agree to update their information promptly to ensure accuracy.

3. PRACTITIONER RESPONSIBILITIES

• Practitioners must provide valid credentials, certifications, and professional information during registration, which the Company will verify to the best of its ability.
• Practitioners bear full responsibility for the advice, recommendations, and information they provide during advisory, guidance and educational support.
• While the Company strives to ensure that Practitioners are qualified, it does not guarantee or verify their expertise or credentials beyond the registration process.
• Practitioners must comply with relevant laws, including those governing their profession under Indian regulations.

4. PAYMENTS AND FEES

• The Platform offers both free and paid advisory, guidance and educational support. Users will be notified in advance of any charges associated with paid advisory, guidance and educational support.
• Payments are processed through the Platform’s integrated payment system, which supports secure transactions.
• The Company retains a commission from each paid advisory, guidance and educational support fee before transferring the remainder to the Practitioner.
• Payments made through the Platform are final and non-refundable, except in cases where the service is not fulfilled or due to technical errors (as determined by the Company).
• Users are responsible for paying any applicable taxes related to the services they avail.

5. LIMITATION OF LIABILITY

• The Company is not responsible for any medical decisions made based on advisory, guidance and educational support or advice provided by Practitioners.
• Users assume full responsibility for their health-related decisions, including the evaluation of advice and information provided by Practitioners.
• The Company shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of the Platform, including reliance on any content provided by Practitioners or other users.

6. USER CONDUCT AND RESTRICTIONS

• Users agree not to use the Platform for any unlawful purpose or in a manner that:

• Posts or transmits false, misleading, defamatory, abusive, or offensive content.
• Engages in fraudulent, deceptive, or illegal activities.
• Violates intellectual property rights, including by posting copyrighted material without permission.

• The Company reserves the right to remove any content, restrict access, or suspend accounts that violate these Terms, without notice.
• Users are also prohibited from using the Platform to engage in spam or unsolicited communications.

7. PRIVACY AND DATA PROTECTION

• User data is collected, stored, and processed in accordance with the Company’s Privacy Policy, which is incorporated by reference into these Terms.
• The Company does not sell or share personal data with third parties, except as required for providing the services, with the user’s consent, or as required by law.
• Users have the right to request access to, correction of, or deletion of their personal data, as specified under Indian data protection laws.
• The Company implements reasonable security measures to protect user data but cannot guarantee complete protection from data breaches or unauthorized access.

8. TERMINATION OF SERVICES

• The Company reserves the right to suspend or terminate any User's account at its discretion, particularly if the User violates these Terms, engages in abusive or illegal conduct, or provides false or misleading information.
• Users may delete their accounts at any time by submitting a request to info@ask-ayurveda.com.
• Termination of the account will result in the loss of access to the Platform, and no refunds will be provided for any unused paid services.

9. GOVERNING LAW AND DISPUTE RESOLUTION

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any disputes arising out of or related to these Terms shall be resolved through amicable negotiations. If unresolved, the dispute will be referred to arbitration in accordance with Indian law.
• The venue for any dispute resolution or arbitration shall be Bhopal, Madhya Pradesh, India, and the courts of Bhopal will have exclusive jurisdiction over any legal matters.

10. CHANGES TO THESE TERMS

• The Company reserves the right to modify or update these Terms at any time. Any changes will be posted on the Platform, and the updated Terms will take effect as of the "Effective Date" noted above.
• Users are encouraged to review these Terms periodically to stay informed of any changes.
• Continued use of the Platform after modifications to these Terms constitutes acceptance of the updated terms.
