ASK-AYURVEDA.COM USER AGREEMENT
Effective Date: 25th November, 2025
This User Agreement ("Agreement") governs the use of Ask-Ayurveda.com ("Platform"), operated by SWISS AYURVEDA PRIVATE LIMITED ("Company"), registered in India under CIN U86901MP2024PTC073695, with its registered office at H. No. 186, Bhel, Bhopal, Huzur, Madhya Pradesh, India, 462022.
By accessing or using the Platform, you agree to be bound by this Agreement. If you do not agree, please discontinue use immediately.
1. NATURE OF THE SERVICE
- The Platform is an IT-based solution that facilitates interactions between Users and independent Ayurvedic practitioners ("Practitioners").
- The Company does not provide medical services, and is not a healthcare provider, clinic, or hospital.
- Any medical advice, recommendations, advisory, guidance and educational support on the Platform are provided solely by independent Practitioners who are responsible for their services.
- The Platform is not a substitute for in-person medical care, and Users should seek direct medical attention for any medical emergencies.
2. USER RESPONSIBILITIES
Users agree to:
- Provide accurate and truthful personal information during registration, including but not limited to, their name, contact details, and health-related inquiries.
- Use the Platform solely for legitimate health-related inquiries.
- Not misuse the Platform for emergency situations or life-threatening conditions. In case of medical emergencies, Users must seek immediate assistance from appropriate healthcare professionals or services.
- Acknowledge that any advisory, guidance and educational support provided through the Platform are for informational purposes only and do not replace in-person medical care.
- Not rely solely on advice provided through the Platform for critical health decisions.
- The Company is not liable for any consequences arising from reliance on Practitioner advice provided through the Platform.
3. ACCOUNT REGISTRATION AND SECURITY
- Users must create an account by providing a valid email address, phone number, and any other necessary details as requested by the Platform.
- Users are solely responsible for maintaining the confidentiality of their account credentials and for all activity occurring under their account.
- In the event of a suspected security breach or unauthorized access, Users must immediately notify the Company at info@ask-ayurveda.com.
4. ADVISORY AND PAYMENTS
- The Platform offers both free and paid advisory, guidance and educational support, as indicated during the registration or service selection process.
- Payments for paid advisory, guidance and educational support are processed through the Platform’s integrated payment system.
- The Company retains a commission from each paid advisory, guidance and educational support before transferring the remaining balance to the Practitioner.
- Users acknowledge that all payments made through the Platform are final and non-refundable, except in cases of technical errors or if a Practitioner is unavailable.
5. MEDICAL DISCLAIMER
- The Platform does not provide medical diagnoses, treatments, or prescriptions.
- The Company does not endorse, verify, or control the information provided by Practitioners, and does not assume responsibility for the accuracy or appropriateness of such advice.
- Users are solely responsible for their health decisions and should consult a qualified medical professional for any serious or urgent health concerns.
- The Company shall not be held liable for any adverse effects, including health complications, arising from advice provided by Practitioners.
6. TERMINATION AND SUSPENSION
- The Company reserves the right to suspend or terminate User accounts in the event of:
- Providing false or misleading information during registration or advisory, guidance and educational support.
- Engaging in abusive, fraudulent, or unlawful activity.
- Violating any terms of this Agreement or any applicable laws.
- Users may terminate their accounts at any time by providing written notice to the Company at info@ask-ayurveda.com.
7. DATA PRIVACY AND SECURITY
- The Company collects, processes, and protects personal data in accordance with its Privacy Policy, which is available on the Platform.
- User data will not be sold or shared with third parties, except for service-related purposes necessary for the operation of the Platform (e.g., payment processing, communication with Practitioners).
- While the Company implements reasonable security measures, it cannot guarantee absolute protection from data breaches. Users should exercise caution when sharing personal health-related information online.
8. LIMITATION OF LIABILITY
- The Company is not liable for the accuracy, completeness, or effectiveness of any advice provided by Practitioners, and does not guarantee the results of any advisory, guidance and educational support.
- The Company is not responsible for any technical failures that may affect the access or functionality of the Platform.
- Users agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents against any claims, damages, or losses arising from their use of the Platform.
9. GOVERNING LAW AND DISPUTE RESOLUTION
- This Agreement shall be governed by and construed in accordance with the laws of India.
- Any disputes arising under this Agreement shall be resolved through amicable negotiation. If the dispute cannot be resolved through negotiation, it will be referred to arbitration under the jurisdiction of courts in Bhopal, Madhya Pradesh, India.
- Users agree to comply with all applicable laws and regulations of India, including but not limited to data privacy laws and consumer protection laws.
10. AMENDMENTS AND MODIFICATIONS
- The Company reserves the right to modify this Agreement at any time, with or without prior notice.
- Continued use of the Platform after any modifications to this Agreement constitutes acceptance of the updated terms.
